Virtual Mediation: Connecting People Wherever They Are
As a reminder, virtual mediation is a process by which parties can settle their disputes online without the need for in-person appearances. Meetings are conducted by video, teleconference, or over the phone. We know for a fact, that is not uncommon for parties to reside in different places: in another county in another state and/or in another country. At MPSV, we give a chance to all parties to be part of the mediation process by working remotely with those who cannot attend in person whether they are family members, beneficiaries, lawyers, etc.
Based on our experience, virtual mediations are not different from in-person mediations. In both cases, the deciding factors remain the willingness of the parties to mitigate their differences and to find a solution that can benefit all of them as well as the commitment and persistence of the mediators to help the parties reach a settlement.

WHY DID WE CREATE MEDIATION PATH ?
Because we were not content with what currently exists to solve family disputes amicably, we decided to create our own mediation process and with it our own mediation center. Before creating MPSV, we studied and utilized many types of dispute resolution protocols.
MPSV was established after we put together a new collaborative ultimate level problem solving model derived from our past knowledge and experience. Since we have used this new approach our success rate has significantly increased.
Conflicts in families arise in many situations. For instance in Trust and Estate disputes the most common causes of conflict are: Deciding what level of care an elder will receive and who will be responsible for their finances - When a deceased parent's will or trust is not clear about how property is to be distributed - When an estate is not divided equally among the children and changes to the estate planning documents were made after the parent was diagnosed with dementia or days before death -When the trustee administering the trust has taken action that other beneficiaries find questionable.
In all cases, the dispute derives from one common denominator : the lack of communication between parties leading to misunderstanding and resentment.
In our model, we work with the parties to identify their interests and needs. We collaborate with them to fully develop not only their expressed position but also their underlying concerns. We ask that each party fully listen and understand the position and underlying concerns of the other party. From this understanding we guide the parties to develop a joint mission statement of their objectives.

This way we can defuse participants’ hard feelings towards one another in order to identify possible solutions. We also work with neuro-psychologists to understand how mental diseases might be affecting a person’s ability to make decisions.
